All brand names, logos, business names, distinctive signs, services, contents, texts, photographs, graphics, images and software which appear on this Web site, are the property of Travel Nexus Spain, SL. No part of it can, thereby, be reproduced, distributed, publicly communicated, altered or modified without express authorization.
Travel Nexus Spain, SL will not be responsible for infringements of intellectual property or industrial rights of third parties originating from the inclusion in the website of trade marks, business names, industrial designs, patents, designs, texts, photographs, graphics, logos, icons or software corresponding to third parties who, when including them in the website, have declared they are the title owners of the same.
The user is obliged to use the contents of the website in a conscientious, correct and legal manner and undertakes:
• a) Not to use the contents for objectives or purposes contrary to the law, to public morals and to normal customs or public order.
• b) Not to reproduce, copy, distribute, allow public access by whatever means of public communication, transform or modify the contents, unless the corresponding authorization from the title owner thereof has been given.
• c) Not to use the contents of the website to send publicity, communications for purposes of direct sales or for any other commercial purpose, unsolicited messages sent to a multitude of people regardless of its purpose, and to abstain from marketing or divulging such information in any way.
In the event of any kind of dispute, both parties will try to come to a friendly agreement. If this is not possible the Courts of Barcelona will have jurisdiction to deal with the case and the parties will not have recourse to any other jurisdiction for the purposes of legal action.

3.- Modifications of the Terms of Use and Privacy Policy

Travel Nexus Spain, SL reserves the right to modify its Terms of Use and Privacy Policy when deemed necessary. Users should check the contents of these Terms of Use and Privacy Policy, as well as understand and accept each and every one of the clauses contained in this document. It is the complete responsibility of the user to check all of the above-mentioned terms.

4.- General Terms and Conditions

 All of the rates are in Euro.
 Rates are Net, non-commissionable.
 Rates are valid for the indicated period of time and minimum number of previously agreed pax.
 Rates are based on an entire group travelling together and the total volume of services quoted. Should there be a significant variation on the requested services and/or should the group be split to sub-groups, rates will be revised and services changes may be added.
 Unless otherwise specified, all rates include all local taxes. TVNX maintains the right to charge or refund differences should the legislation change.
 We are not holding any space at the hotels or restaurants therefore, in case interested please advise in order to make the necessary tentative/optional reservations.
 We are holding space at the hotels or restaurants therefore, in case of cancellations or substantial changes, fees may be charged.
 Hotel rates are based of GROUP RATES of minimum 20 Pax and 10 Rooms with a maximum of 10% of the total number of rooms allocated to Singles (or "Double Rooms for Single Use").
 Rooming lists with client requests (room type, special diets, etc.) must be sent 2 weeks before arrival
 All special requests e.g. bed type, non-smoking room, connecting, etc. cannot be guaranteed and will be confirmed only by the hotel upon arrival, based on availability.
 Services not mentioned in the above lists are not included in the package.
 Rates do not include site inspection costs
 Unless clearly indicated, rates do not include frees.
 It is understood that changes may occur and any correspondence with requests as well as explicit confirmations will be accepted as annexes to this contract.
 In the case of last-minute changes and all the extra work that is involved with it, please note that TVNX will do its utmost accordingly, however:
 TVNX cannot guarantee any services (Such as: Extra hotel rooms at group rates, Transportation, etc.) and/or entrance fees (Such as: The Royal Palace in Madrid, Th Sagrada Familia in Barcelona or the Alhambra in Granada) requested shortly before the arrival of the group.
 TVNX reserves the right to charge extra handling fees when or if these occur.

5.- General Conditions of Bus Transportation

 Bus & guide or assistance services have been quoted for the indicated minimum number of pax mentioned in above table.
 Host/ess or Guide
 A host/ess or guide must be present in all bus transportation services at the given rates.
 A local guide is required for all tours NOT done exclusively on a bus (i.e. in case of bus Panoramic Tours, local guide is not required).
 In case transportation is not required, a host/ess or guide must be present during the services provided by TVNX at given costs.

6.- Special meal requirements (Including KOSHER)

 CLIENT is obligated to advise TVNX by maximum 2 weeks before the groups' arrival on the group's menus as well as special meal requirements of the group participants. This includes Vegetarians, Vegans, Kosher, Celiac, etc. Any failure to do so will exempt TVNX of all corresponding responsibilities.
 TVNX will do its utmost to satisfy all requirements however, the final service providers have the full and final responsibility on the products served.
 As a general rule (with Israeli / Jewish Markets), TVNX requests "KOSHER STYLE" menus from all meal providers (Hotels, Restaurants, Caterings, etc.). These include the following standards:
 No pork
 No seafood
 No mixing of dairy and meat products
 In reference to KOSHER GROUPS, the following conditions apply:
 Kosher services are very limited throughout Spain and therefore limited by the flexibility, generosity and capacity of the suppliers.
 All requests will be handled with maximum attention however not everything is automatically confirmed and whatever is, will be done so in writing.
 Any and all KOSHER requirements must be sent in writing to TVNX at the moment of request and moreover in the moment of the confirmation of the group.

Within these requirements are included:
o Level of KOSHER required (Kosher Style, Fish in papillote, Glat or other)
o Extra products for lunches or picnics (Bread, vegetables, fruit, etc.)
o Number and quantity of food brought from country of origin (Number and size of boxes) and whether or not refrigeration and/or storage is/are required.
o Kitchen access in full detail
o Extra accommodations for cooks and other staff (Note: Staff rooms cannot be used as an alternative for kitchens. Any damage and/or extra cleaning charges will be charged accordingly)
o Rooms for prayers
o Special requirements for Shabbat (Rooms in low floors, Non-electronic keys, Dinner, Prayers, Seuda Shlishit, etc.)

 The given solutions for Kosher by regular suppliers is based on what is offered by local Kosher suppliers, natural and unprocessed products (Vegetables, Fruits, Fish), Fish in tin aluminum foil ("Papillote" Style) or acceptable products that can be purchased locally.
 It will not be taken for granted that group cooks or representatives will have free or unlimited access to the supplier's installations (Primarily Kitchens). This may be possible only with the written consent of the suppliers.
 It will not be taken for granted that special services (Private meeting or event rooms, special products, staff support outside official service times, etc.) will be offered to groups at no extra cost as respect to the unique requirements of the group. All services will be quoted and charged accordingly.
 Information sent to CLIENT regarding confirmed Kosher services will be respected by the group participants as well as their guides, escorts, cooks and/or other staff.
 TVNX maintains the right to take all necessary measures and require compensations if applicable where clients, guides, escorts, cooks or other staff do not comply with the confirmed services and/or demand additional services which involve costs and/or behave in any disrespectful manner with local staff and suppliers.

7.- Payments

 As soon as group is confirmed, an immediate non-refundable deposit of 25% of total proforma is required for guarantee of all services.
 35% of updated proforma must be prepaid up to 90 days before the arrival of the group.
 25% of updated proforma must be prepaid up to 60 days before the arrival of the group.
 15% of updated proforma or remaining difference between payments made the final proforma must be prepaid 30 days before the arrival of the group.
 Specific supplier terms and conditions may be presented separately and will be based on their specific requirements.
 All payments must be made free of charges to Travel Nexus. In case charges will be applied, client will be required to cover them accordingly.
 In case payments are done via bank transfers, all charges must be on the client (OUR).

8.- Partial Cancellation Policy

 All cancellations of Tours must be notified to us in writing. The cancellation date will be deemed to be the date on which we receive the notification in writing.
 Should there be any cancellations, the final PP rate applied will correspond the actual number of pax based on the following limitations:
 15% of services confirmed (in number of PAX) can be canceled up to 60 days before group arrival. For any additional sum above, a 10% cancellation fee will be charged.
 10% of services confirmed (in number of PAX) can be canceled 59-30 days before group arrival. For any additional sum above, a 25% cancellation fee will be charged.
 5% of services confirmed (in number of PAX) can be canceled up to 29-15 days before group arrival. For any additional sum above, a 50% cancellation fee will be charged.
 From 14 days before arrival no refunds will be offered and a 100% cancellation fee will be charged.
 There will be no refund for non-shows and/or unused services.
 Specific supplier terms and conditions may be presented separately and will be based on their specific requirements.

9.- Full Cancellation Policy

The following refers to a full group cancellation.
 If a group is cancelled up to 90 Days before arrival or after receipt of 25% deposit the deposits will be charged as cancellation fee.
 89-60 Days before arrival 50% of total services confirmed will be charged as cancellation fee.
 59-30 Days before arrival 75% of total services confirmed will be charged as cancellation fee.
 29 or less days before arrival 100% of total services confirmed will be charged as cancellation fee.

10.- Liability and Reponsibility

 Given that official hotel and restaurant ratings vary both locally and worldwide, corresponding categories are for indication only.
 Tour itineraries may be subject to change at the discretion of the Tour Operator based on force majeure or other impediments.
 It is highly recommended to buy a cancellation, health and luggage insurance prior to arrival.
 Travel Nexus Spain, S.L. acts as an agent for companies, owners or contractors providing transportation, hotel accommodations, activities, or other services and as such are not in any way liable for injury, loss, damage, delay and/or accident caused by reasons beyond our control.
 As any type of personal insurance is not included in the above services, it is highly recommended for the guests to purchase a cancellation, health and luggage insurance prior to arrival.

11.- Complaints & Refunds

 TVNX will do its utmost to correct, refund and/or offer alternatives in case of complaints on given and confirmed services in the moment they occur. In case complaints are not notified immediately and advised only at a later date, TVNX, will not offer any refunds or any other type of compensation.
 Any and all complaints and/or problems must be communicated to TVNX immediately. No refunds and or discounts will be given prior to guests' departure from Spain.

12.- Force Majeur

 The terms of this agreement shall be rendered null and void in the event of force majeure such as war, major strikes, catastrophes, epidemics, and other events occurring, which outside of the reasonable control of the parties of this agreement.

13.- Confidentiality

 The clauses of this agreement are confidential, wherefore the client undertakes not to divulge the terms and economic conditions of this agreement or to assign or to subcontract the services mentioned to any other person or entity not associated with Travel Nexus Spain, SL.

14.- Copyright

 CLIENT warrants that unless permitted in writing, it will not use the names, photographs, images, designs, logos, texts, trademarks or any other distinctive signs owned by TVNX.
 CLIENT agrees that it will not harm the image of and/or cause confusion regarding ownership of and/or divulge false or incorrect information on/or about TVNX.

15.- Data Protection Act

 CLIENT warrants that the personal data provided has been obtained, processed, transited and collected in compliance with the European Directives 95/46 and 2002/58 and other legislation which implements, settles or replaces them, particularly the Personal Protection Act 15/1999 of 13 December.
 CLIENT warrants that it has implemented the organization and technical security measures necessary to guarantee the safety of the personal data and prevent their alteration, loss or unauthorized use and/or access.

16.- Jurisdiction

 The present contract will be governed by the terms of the clauses contained herein, by the regulations of the European Law applicable to the contracting of Travel Agencies services, and failing the former, by the bylaws of Common Law applicable to the same.
 In case of dispute, once notification has been sent both sides agree to do their utmost to clarify all issues disputed immediately. If this is not possible, the law of Spain will apply and you agree to submit to the non-exclusive jurisdiction of the courts of Barcelona.
 Any dispute concerning the interpretation of this contract will be referred to the Barcelona Court under the Spanish Law.

17.- Duration of the Contract

 The contract herein will take effect as from the date of signature by both parties concerned and will terminate at the given termination date or once the services have been rendered and these have been mutually settled.
 This agreement will prevail in front of any other one that may have been signed before.
 For any non-compliance with this contract both parties maintain the right, with 2 weeks (14 Natural Days) prior notice, to consider it null and void thereby terminating it with all guaranteed costs paid.
 Should any financial obligations remain pending, it is within the aforementioned period of 2 weeks (14 Natural days) that they must be closed and all payments handled.
